Common Post-Divorce Issues
The most common post-divorce issues that we help clients with are modifications to child support, custody and visitation. Occasionally we help with a change in spousal support, though this is not something the courts like to do.
Increasingly we work with parents who want to relocate to another community or another state with their child. REMEMBER, the other parent has rights and Virginia courts are zealous in protecting the access that both parents have to their children.
If you want to relocate, you must give the other parent 30 days notice of your intent and your change of address. The non-custodial parent then has the option to file an emergency request for a stay order to prevent the move until the courts review the existing child custody order and decide where the child should stay.
The court looks at the child's best interest when making a decision, not simply the best interest of the parent. It is vital to work with an experienced child custody attorney who can help you make a strong case to protect your relationship.
